Hammer of Justice is gone :(

I am in the jailhouse and when I went to go and break the silver rocks, I couldn't do it, then I searched my inventory and my hammer of justice is gone, I know I didn't sell it or anything, is this a glitch? Please tell me I don't have to start my game over.
